Lonely Planet’s Explore API - Terms of Use
Lonely Planet is really excited about creating new ways to enable travellers to connect with one another and build their community. Lonely Planet’s Explore API is a toolkit that will allow you to experiment with Lonely Planet’s content and use it noncommercially to design and build your new and creative ideas. We want you to create, develop, build and share your ideas with us. However, by registering to access Explore API, you agree to the following terms of use.
Lonely Planet’s Explore API includes:

the Lonely Planet Application Programming Interface (API);

the Lonely Planet content and applications available via the API (Content); and
-
any code examples that we make available to you via the Explore API Blog or Documentation (Code).
Explore API is only available to users who have registered and been accepted by Lonely Planet. We may change these terms from time to time, and we may not let you know when we do, so check them regularly. In these terms, “we” refers to Lonely Planet Publications Pty Ltd and “you” refers to the registered user.
How can I use Explore API?

You can use Explore API only as expressly permitted under these terms of use.

With Explore API you can experiment with Lonely Planet’s content, test new and exciting ideas, and develop and build those ideas (eg mash-ups, applications incorporating Lonely Planet content, software, etc.) (Applications)

Your Application may interface with the API to access Content. You can use Content in your Application. However, you must not copy Content you access via the API for use outside of your Application, including any offline use.

Your use of Explore API is subject to the technical requirements and restrictions outlined in the Documentation.

Code is provided to you as an example of how we use the API. You can only use the Code to understand and learn from how we use the API and to create Applications.
How can’t I use Explore API?

Explore API is made available to you only for your personal and noncommercial use. Amongst other things, this means that you can’t commercialise any Content or any of your Applications. If you want a better idea of what commercialisation may include, check out our FAQs.

You may not distribute your API key or any part of Explore API, including any Code or Content, to anyone else.

In addition, when using Explore API you agree:

not to use the API in any way that disrupts any of our websites or services;

that your Applications will not:

be racist, sexist or homophobic, or defame, harass or attack another person;

disclose personal details or private information about any other person (or anything contrary to our privacy policy)

advertise your or any other person’s services;

display content which would be contrary to any applicable content regulations, such as any content that is rated R, RC or X by the Australian Classification Board (for more information please see the Office of Film and Literature Classification web site at www.oflc.gov.au);

that you will not make any editorial changes to the Content, including doing anything that changes the meaning of the Content, removing any disclaimers or intellectual property or other notices from the Content or doing anything that would suggest the Content is yours;

not to use Explore API for any purpose which is illegal, likely to damage our standing or reputation or otherwise inappropriate; and
-
not to breach any intellectual property rights law or commit any other legal activity.
Is there anything else I need to know when creating an Application?

You must include an attribution to Lonely Planet and a link back to www.lonelyplanet.com. on anything you create using Explore API (including any Applications). The attribution must be in the form described in the FAQs Other than including an attribution to Lonely Planet, you must not use any Lonely Planet trade marks or logos (including the Lonely Planet name) without our permission.

You can combine the Content with any third-party content, but make sure you abide by any applicable terms and conditions.

Remember, the purpose of us making Explore API available to you is so that you can be creative and experimental, and use our Content in innovative and exciting ways. So you must not use Explore API to create something that is substantially the same as one of our existing products or service (see FAQs).
Hosting and submission of Applications

You agree to give us access to your Application (see FAQs ) via the URL that you have registered with us. You agree to host your Application on that URL.

We may publish your URL on one of our websites or services so that other people can check out what you’ve done. We understand that you may not be able to maintain your URL forever, but you otherwise agree not to do anything to prevent us accessing or linking to your Application.
What happens to Applications?

You own your Application and we own the Content and the API. This means that you own the copyright and other intellectual property rights in your Application (see FAQs), but we own any Lonely Planet content you include in your Application.

You grant us a right to use your Application for promotional and marketing purposes, including by displaying your Application on, or linking to your Application from, any Lonely Planet website or service or marketing materials.

We will contact you if we really like your Application and we are interested in using it for purposes other than promotional and marketing purposes. If we haven’t contacted you but you would like to commercialise your Application, contact us. Either way, both we and you agree to negotiate in good faith to see how we may work together.

However, be aware that Lonely Planet is constantly thinking up new ways to use the Content and we may already be independently developing an idea similar to yours. We can continue to develop and use that idea without your permission.
How long can I continue using Explore API?

You can continue using Explore API for as long as we make it available to you. However, we can’t guarantee that we will make Explore API available continuously or forever. We may decide to modify or discontinue Explore API at any time.

We may also block or terminate your access to Explore API at any time and for any reason we think reasonable, including if you breach these terms or any other applicable Lonely Planet terms.

If we discontinue Explore API or we terminate or block your access to Explore API, you agree to stop using the Content and delete all copies of the Content that you have created, including any archives and Content included in any Application.
What else do I need to know?

We will try hard to maintain Explore API, but it is provided “as is” and on an “as available” basis. We can’t guarantee that it will always be operational or fault free. To the extent possible, we disclaim all implied warranties, including implied warranties of quality, fitness for purpose, non-infringement and accuracy. We are not responsible to you or anyone else for any loss, damage, liability, cost or expense suffered in connection with Explore API. We will never be liable for any indirect, incidental, special or consequential loss, or loss of business profits or revenue arising out of the use of Explore API.

Lonely Planet’s intellectual property (which includes the API, the Content, Code and Lonely Planet’s logos and trade marks) may not be used in any way or for any purpose without our permission. This includes not republishing or redistributing the Content or Lonely Planet’s trade marks, including by framing or by similar means, except as permitted by these terms of use. You supply us with personal information when you register, use Explore API or contact us. The purpose of us collecting this information is to administer and help you use the API, send you your API key, contact you about your Application and otherwise keep in touch with you. Our privacy policy applies to your personal information.

Any legal issues arising will be dealt with under the laws of Victoria, Australia.
